What Is Mediation?

Mediation is an informal and flexible dispute resolution process.  Our role is to guide the parties toward their own resolution mainly through joint sessions with the parties.

The ultimate goal is to finalise and prepare a written document for the parties to sign which clearly sets out their rights and obligations towards each other, and which document can also be made an order of Court if necessary.

Who Is Meditation For?

Mediation is for people that want an out-of-court solution, that is cost-effective and productive.

Mediation is often a more cost-effective and productive route for those dealing with divorce and separation, compared to outright litigation.

What is The Process Like?

Mediation is conducted through 50-minute sessions ideally with both parties present.  We will refine the issues and assist the parties in working towards resolutions relating to finalising their Divorce, separation, and co-parenting.

The goal of these sessions is to finalise and prepare a written document (which includes a Settlement Agreement and/or a Parenting Plan) for the parties to sign, and which document can also be made an order of Court if necessary.

1. Mediation Sessions

The mediation process takes between 3 and 6 sessions of 50 minutes each.

2 Sessions can be booked back-to-back if you prefer (i.e. a 1 hour 40 minute session).

When we act as your Mediator, we cannot act as Attorney for either party if the mediation process breaks down.

This allows you to speak freely with us.

Ideally, both parties should be at each session but we can see the parties individually if necessary.  TAKE NOTE: Seeing the parties individually will make the process longer and more sessions will likely be required.

If Mediation is successful and both parties agree, we can act as the attorney for both parties and handle the divorce proceedings with the Courts.

We can meet at our offices in Greenside Johannesburg or we can offer Mediation Sessions via Video on Skype or Whatsapp.

Mediation Sessions that are cancelled without at least 24-hours notice will be charged for at full price.

2. Settlement Agreement

At the end of the mediation process, you will be provided with a Settlement Agreement.

The Settlement Agreement will record the terms agreed to during the mediation process and will be used to apply to Court to confirm the divorce.

3. Parenting Plan

Parenting Plans are drafted where there are minor children involved.  In the case of divorce, this will be incorporated into the Settlement Agreement.

Where the couple is unwed, the Parenting Plan is drafted on their own.

4. Scope of Mediation

Mediation includes disputes relating to all personal relationships between parties, including with reference to:

  • Marriage (Civil and religious)
  • Customary Unions
  • Partnership Agreement governing a personal relationship
  • Parties cohabiting
  • Separation mediation
5. After Mediation

 The written agreements that are drafted during the mediation and signed by the parties are binding on the parties.

This means that the parties must act as set out in the written agreements.

In the case of Divorce, it is necessary, to apply to Court to finalise the Divorce.

The Settlement Agreement will be used as the terms of the Divorce.

The Divorce proceeding at Court will be conducted on an “uncontested” basis as there is now a written agreement (the Settlement Agreement) signed by the parties.

If there are minor children, only one of the parties will need to be at Court when the divorce is finalised.  Sometimes, nether party is required when we go to Court (especially when there are no minor children).

We can handle the Divorce proceedings for you (see you costs below).

Costs of Mediation

We provide you with options to help you make the process of mediation as cost-effective as possible.  The total cost will depend on how complex the issues between the parties are.

We charge a Fee per Mediation Sessions and the Fee must be paid before we start your session.  If you buy more sessions upfront the total cost will be less.

  • Settlement Agreement drafting costs. For complicated Settlement Agreements, we may charge an additional fee, that will be discussed.
