Mediation is an informal and flexible dispute resolution process. Our role is to guide the parties toward their own resolution mainly through joint sessions with the parties.
The parties must be willing to try to work out a solution with the other party.
The mediator does not take sides or make decisions for the parties.
The ultimate goal is to prepare a written document for the parties to sign which clearly sets out the parties rights and obligations towards each other, and which document is enforceable and binding on the parties; and, can be used to finalise a Divorce in Court.
We mostly mediate to assist the parties in work-out the terms of their Divorce and/or complete a parenting plan.
We record the terms of the parties’ agreement in a Settlement Agreement that is signed by the parties. The Settlement Agreement is then placed before a Court as part of a Divorce summons and made an Order of Court.
